General Terms and conditions, as of August 2022
1. scope of application
Welcome to Team WellVivo! For all business relations between Sascha Pölzl / WellVivo and you as the customer, the following General Terms and Conditions apply exclusively in the version valid at the time of the order.
2. conclusion of contract
Your order is an offer to conclude a purchase contract. When you place an order with WellVivo, we will send you an e-mail confirming receipt of your order and listing the details of your order. This order confirmation is not an acceptance of your offer, but is only intended to inform you that we have received your order. A purchase contract is only concluded when you have made the payment.
We do not offer products for purchase by minors.
3. right of revocation, revocation instruction
You can revoke your contractual declaration by e-mail within 14 days without giving reasons. The period begins after receipt of this instruction in text form, but not before use of the site (in the case of recurring use not before receipt of the first period of use) and also not before fulfillment of our statutory information obligations. Timely dispatch of the revocation is sufficient to comply with the revocation period.
In the event of a withdrawal, please contact us by e-mail and we will let you know how we can reverse the purchase. After we have received your e-mail, we will transfer the full invoice amount back to your account within 7 days.
4 Due date and payment, default
The purchase price is to be paid by credit card or via PayPal. If the customer is in default of payment, default interest in the amount of 5% above the base interest rate p.a. announced by the European Central Bank shall be deemed agreed. Any additional damage caused by delay can be claimed separately.
5. prices
All prices include the applicable statutory sales tax. The prices currently displayed in the webshop apply.
6. collection, processing and use of personal information
The information we receive from you helps us to personalize and continuously improve your shopping experience. We use this information for the processing of orders, the delivery of goods and the provision of services as well as the processing of payments. Your information is also used to communicate with you about orders, products and services and to update records and maintain and service your customer accounts and ultimately to improve our platform, detect or prevent misuse of our website or to allow third parties to perform technical, logistical or other services on WellVivo’s behalf. However, we do not make your personal data available for use by third parties.
7. force majeure
Should we be prevented from fulfilling the obligations arising from a purchase contract due to force majeure or circumstances beyond our control, WellVivo accepts no liability.
8. copyright
Copying or reproduction (including printing on paper) of the entire website or excerpts thereof is only permitted with the written permission of WellVivo/Sascha Pölzl. 9 Applicable law and final provisions
Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict of laws rules. The place of jurisdiction and place of performance is Vienna.
All agreements – as well as any deviation from this point itself – must be made in writing. The contract language is German.
